The Directorate E of the DG for Budget (DG BUDG.E) of the European Commission (EC) is in charge of the asset management of the multiple guarantee funds, competitions fines and the off-budget assets for other EC services and other EU institutions.
In that context, it closely monitors financial risks associated with the asset management activities of the directorate, ensures reporting on the risks and performance; monitors the asset management activities outsourced to third parties and develops risk management systems and processes.
In order to ensure that the EC fulfils its obligations, DG BUDG.E needs to access the ratings and financial research services.

Explanation:
Pursuant to Article 164(5)(f) FR, the use of a negotiated procedure without prior publication of a contract notice, in the clearly defined exceptional circumstances set out in Annex I (point 11.1) FR is proposed: ‘where the works, supplies or services can only be provided by a single economic operator under the conditions set out in point 11.3 and for any of the following reasons: [...] (ii) competition is absent for technical reasons’. This provision concerns the exceptional situation where there is only one particular service provider, when no reasonable alternative or substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters when defining the procurement. The services required by the EC can only be provided by Moody’s Analytics UK Limited. The Commission needs to access these services that can be provided only by a single operator in the situation laid down under point 11.1 of Annex I FR.
