Faktiline alus: Hankelepingu muutmise tingisid ettenägematud asjaolud maagaasi turu hetkeolukorras, mida hoolas hankija ei saanud 2019.a raamlepingut sõlmides ette näha. Raamlepingu osalised ei saa tulenevalt turuolukorrast pakkuda fikseeritud hinnaga maagaasi, samuti ületavad maagaasi turuhinnad oluliselt kõikide raamlepingu osaliste pakutud maksimaalseid ühikuhindasid ning vastavalt sellele soovivad Pooled muuta raamlepingus fikseeritud maksimaalse ühikhindade sätted kehtetuks.
