Zakres rzeczowy przedmiotu zamówienia obejmuje sumaryczne ilości prac z zakresu pozyskania i zrywki drewna do wykonania na terenie Leśnictw Osuchowa, Nowiny i Brzostowa w roku 2022 wynikające z Załącznika nr 3 do SWZ, na który składają się:

Załącznik nr 3.1. – rozmiar prac według grup czynności, czynności i lokalizacji;

Załącznik nr 3.2. – układ sortymentowy pozyskania drewna;

Załącznik nr 3.3. – zestawienie odległości i warunków zrywki drewna;

Załącznik nr 3.4. – zestawienie pozycji nieudostępnionych dla maszynowego pozyskania drewna;

Załącznik nr 3.5. – informacja o optymalnej możliwej do zastosowania technologii pozyskania drewna.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

W trakcie realizacji Umowy, w następstwie agresji Federacji Rosyjskiej na Republikę Ukrainy, nastąpił gwałtowny wzrost cen paliw płynnych w stosunku do cen obowiązujących w okresie poprzedzającym postępowanie o udzielenie zamówienia publicznego poprzedzające zawarcie Umowy; wzrost cen paliw płynnych, o którym mowa w pkt (I) nastąpił w wymiarze, którego Zamawiający działając z należytą starannością, nie mógł przewidzieć;agresja Federacji Rosyjskiej na Republikę Ukrainy jako zdarzenie będące przyczyną wzrostu cen paliw płynnych, o którym mowa w pkt (I) jest zdarzeniem, którego Zamawiający nie mógł przewidzieć działając z należytą starannością; wzrost cen paliw płynnych, o którym mowa w pkt (I) powyżej przekracza normalne ryzyko kontraktowe, które należy uwzględnić w kalkulacji ceny i rodzi obiektywną konieczność wprowadzenia mechanizmu rekompensaty w odniesieniu do tych cen jednostkowych czynności wchodzących w skład Przedmiotu Umowy, w których paliwo stanowi istotną część kosztów.
