Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

W związku z zaistniałą sytuacją epidemiologiczną w kraju (epidemia COVID-19, tzw. „koronawirus”), która spowodowała wyjątkowe okoliczności wymagające pilnego wprowadzenia szczególnych środków i rozwiązań na rzecz zabezpieczenia płynności w przedsiębiorstwach, w szczególności MŚP, oraz utrzymania miejsc pracy, instytucje mające wpływ na politykę społeczno-gospodarczą w Polsce podjęły działania mające na celu ograniczenie potencjalnych negatywnych skutków gospodarczych epidemii koronawirusa. Sytuacja nie była możliwa do przewidzenia w dniu zawarcia Umowy, ale istotnie zmienia uwarunkowania jej realizacji, co najmniej w 2020 r. (siła wyższa). W związku z tym Menadżer zmuszony był do natychmiastowej reakcji, niezbędnej do ograniczenia bezpośrednich skutków epidemii w odniesieniu do firm korzystających z Produktów. Wyjątkowy charakter sytuacji i jej skutki stanowią wypełnienie przesłanek określonych w art. 144 ust. 1 pkt 3 ustawy z dnia 29 stycznia 2004 r. - Prawo Zamówień Publicznych.
