Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Ao abrigo do disposto no art.º 314.º do CCP, conceder o direito à reposição do equilíbrio financeiro do contrato dos sobrecustos suportados pela perda de isenção do ISP entre 01-01-2021 e 13-06-2021 , no valor total de € 259.197,09,atendendo que à data de apresentação da proposta, i.e. 22-10-2019, não poderia o consórcio empreiteiro antever a alteração legislativa produzida pela entrada em vigor do Orçamento de Estado 2021.De igual modo, a introdução deste facto novo e inesperado, que nenhuma das partes poderia razoavelmente prever, afeta gravemente os princípios da boa-fé e origina um manifesto desequilíbrio financeiro não podendo ser entendido como um risco próprio do contrato.
