Obiectul specific la care contribuie furnizarea produselor

Obiectivul specific asociat furnizării produselor care fac obiectul contractului este acoperirea necesităţilor în conformitate cu OUG 144/24.08.2020 pentru a combate raspandirea virusului SARS COV-2.

Obiectul contractului îl reprezintă achiziția de Laptop-uri, camere web videoconferință, Table interactive, Routere de rețea, conform OUG 144/24.08.2020 și Ordin 5487/21.08.2020.

Cerinţele impuse prin caietul de sarcini sunt minimale și obligatorii. Oferta care nu respectă cerinţele obligatorii de tip si clasă produs, transport în locaţie, şi garanţie prevăzute în prezentul Caiet de sarcini va fi considerată neconformă şi va fi respinsă.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Necesitatea modificarii survenita in urma unor circumstante pe care o autoritate/entitate contractanta care actioneaza cu diligenta nu ar fi putut sa le prevada [articolul 43 alineatul(1) litera (c) din Directiva 2014/23/UE, articolul 72 alineatul (1) litera (c) din Directiva 2014/24/UE, articolul 89 alineatul (a) litera (c) din Directiva 2014/25/UE] Descrierea circumstantelor care au facut necesara modificarea si justificarea naturii neprevazute a acestor circumstante:. Modificarea contractului a devenit necesara in urma unor circumstante pe care o autoritate contractanta care actioneaza cu diligenta nu ar fi putut sa le prevada.Descrierea motivelor: înlocuirea unui produs ofertat cu un model superior, deoarece modelul ofertat inițial nu se poate livra in termen, din motive independente de societatea noastra (ofertant).Date fiind acestea, apreciem ca aceasta situatie se circumscrie ariei de aplicare a Art. 221 alin. (1) lit. c) din Legea nr. 98/2016, dar si a alin. (11) al aceluiasi articol din actul normativ referit anterior si anume:- inlocuirea produsului cu unul superior este independenta de toate diligentele pe care societatea noastra le poate face pentru livrarea modelului Acer S1386WH- inlocuirea videoproiectorului cu unul superior nu afecteaza caracterul general al contractului si se poate face in baza art 13 din contract, a art. 122 din Legea 98/2016 si a Instructiunii ANAP nr 1/2021- pretul produsului nu se modifica- natura generala a contractului si obiectivul principal urmarit nu se modifica..
