Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Po sklenitvi pogodbe je prišlo do tako izrazitih in naglih spremenjenih okoliščin, da pogodbe v nespremenjeni obliki ni več mogoče realizirati, saj je zlasti za izvajalca izgubila sleherni ekonomski smisel. Spremenjene razmere se nanašajo zlasti na hitro in povsem nepričakovano rast cen ladijskega prevoza. Hkrati je prišlo tudi do izrazitih sprememb na trgu cestnih prevozov v Republiki Sloveniji, kjer se je zaradi povečanega povpraševanja dostopnost tovornih vozil bistveno zmanjšala, pa tudi podražila, dodatno pa je od predvidenih potrebnih količin soli, ki bi bile dobavljene v višini 90% s prekucniki, 10% pa z avtocisternami, zaradi potreb naročnika, ki želi z načinom prevoza maksimalno zapolniti skladišča, prišlo do bistvenih sprememb v navedenem razmerju dobavljenih količin in se pričakuje dobava z avtocisternami v več kot 10 %. Naročnik sprememb ni mogel predvideti pri oddaji prvotnega javnega naročila, spremembe pa ne spreminjajo splošne narave javnega naročila - dobava soli.
