Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

V skladu z 9. členom pogodbe 2431-19-420254 "Redno vzdrževanje cestne razsvetljave, svetlobno-signalnih naprav in elektro strojne opreme v RS za obdobje štirih let -sklop 3 (CE)", je izvajalec po preteku prvega leta upravičen do valorizacije cen, v skladu z letnim koeficientom rasti cen življenjskih potrebščin po podatkih Statističnega urada RS, pod pogojem, da kumulativno zmanjšanje ali povečanje indeksa cen preseže 4%, in sicer za razliko med zmanjšanjem ali povečanjem indeksa in 4%.

Objavljen koeficient rasti cen življenskih potrebščin v Republiki Sloveniji od začetka leta 2021 do decembra 2021 (Ur.l.RS št.11/2022) je 0,049.

Izvajalec je v skladu z 9. členom pogodbe upravičen do povišanja cen v višini razlike med povečanjem indeksa cen (4,9%) in 4%, kar znaša 0,9%. Povišanje se nanaša na vse postavke v pogodbi.
