Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Zusatzbeauftragung gem. § 365 Abs 3 Z 5 BVergG. Umfasst ausschließlich zusätzliche Lizenzen des urspr. Auftragnehmers, um der Personalentwicklung nachzukommen und stellt notwendige Zusatzleistungen zumindest im Sinne von zweckmäßigen zusätzlichen Leistungen dar. Die ausreichende Lizenzierung des bestehenden KIS ist notwendig für die Aufrechterhaltung des Betriebs. Lizenzen für das bestehende System können nur vom urspr. Auftragnehmer bezogen werden und sind nicht am freien Markt verfügbar. Ein Wechsel des Systems wäre aufgrund der wirtschaftlichen Unverhältnismäßigkeit und aufgrund von wesentlichen technischen Risiken mit erheblichen Schwierigkeiten und Zusatzkosten verbunden. Ein Wechsel wäre nicht nur absolut unwirtschaftlich, sondern würde auch erhebliche technische Schwierigkeiten nach sich ziehen. Der Auftragswert übersteigt außerdem keinesfalls 50% des urspr. Auftragswertes. Die Vergabe wäre auch im Verhandlungsverfahren ohne Bekanntmachung gem. § 36 Abs 1 Z 3 BVergG zulässig.
