VII.2.2)Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Lors d’une réunion avec les impétrants, il a été remarqué que les impétrants allaient être posés « contre » les fosses à arbres.Or une telle proximité pose des problèmes dans le temps suite au développement racinaire des arbres qui viendrait "dans" les impétrants.Pour éviter cela, il faut placer un système empêchant les racines de pousser à « l’horizontale » et les guidant vers le bas.

De plus, La Police nous a imposé une réfection provisoire sur la tranchée impétrant Boulevard de la Constitution afin de faire repasser la circulation avant la réalisation des travaux.

Et enfin, La pose des platines était prévue perpendiculairement à la bordure (Voir qualiroute, métré et CSC).

Le bureau d’étude a confirmé que la pose devait se faire en double diagonale comme partout sur la Ville. Cette précision aurait dû se trouver au CSC
