IV.1.1)Type of procedure
Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below
  • New works/services, constituting a repetition of existing works/services and ordered in accordance with the strict conditions stated in the directive
Explanation:

On 30/12/2017, the Consumers, Health, Agriculture and Food Executive Agency (Chafea) published a contract notice 2017/S 250-526274 for the conclusion of a framework contracts for the provision of surveys on consumer related issues targeting consumers and retailers/providers of good and services. The call for tenders Chafea/2017-CP-03 consisted of the following three lots.

On 16/01/2019, the Consumers, Health, Agriculture and Food Executive Agency (Chafea) signed the multiple framework contract in cascade ‘CHAFEA/2017/CP/03 Multiple Framework Contracts in Cascade to Provide Surveys on Consumer Related Issues – Wave 2, Lot 1: Survey on Consumers’ with two framework contractors.

In accordance with the section 3.3. of the tender specifications of the call for tenders Chafea/2017-CP-03: ‘the contracting authority may exceptionally use a negotiated procedure without prior publication of a contract notice for repetition of similar services with the same contractor on the basis of the provisions of Art. 134 (1) (e) RAP. The new services cannot account for more than 50 % of the initial contract amount. This procedure may only be used within the first three years following the FWC's signature’.

The overall value of the framework contract with regard to lot 1 was: EUR 2 000 000 covering the full four-year duration of the framework contract. Based on the amount ordered to date and the estimated future needs for services covered by this framework contract for the provision of services, sector EISMEA.I.03.2 considered that an increase in the volume of services to be delivered in the context of the said framework contract was required.

The subject of this procurement was to increase, through a negotiated procedure without prior publication of a contract notice, the ceiling of the framework contract for lot 1 by 50 % of the initial contract amount (i.e. EUR 1 000 000) thus increasing the maximum total value of the framework contract for lot 1 to EUR 3 000 000.

The procedure has been launched and completed within three years of the multiple framework contract in cascade signature. In this regard, the initial multiple framework contract in cascade with two framework contractors was signed on 16 January 2019 and the amendment resulting from this negotiated procedure without prior publication of a contract notice was signed on 14 January 2022. Only one framework contractor submitted a tender in the context of this negotiated procedure. The second framework contractor did not submit an offer.
