Налице е фактическият състав за изменение на Договора за доставка на електрическа енергия, съгласно разпоредбата на чл. 116, ал. 1, т. 5 от ЗОП, тъй като след подписване на Договора, Акционерно дружество „ТОКИ ПАУЪР“ АД с ЕИК: 206117083 е придобило Търговското предприятие на „ПАУЪР СИСТ“ ЕООД с ЕИК: 200956954, на основание чл. 15 от Търговския закон, като „ТОКИ ПАУЪР“ АД е правоприемник на „ПАУЪР СИСТ“ ЕООД; от друга страна за „ТОКИ ПАУЪР“ АД не са налице основанията за отстраняване от процедурата, по която е подписан Договора, то отговаря на първоначално обявените критерии за подбор и промяната на Изпълнителя не води до други съществени изменения на Договора и не цели заобикаляне на закона,
