Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Temelj izmjene je članak 317. važećeg Zakona o javnoj nabavi prema kojem javni naručitelj smije izmijeniti ugovor o javnoj nabavi tijekom njegova trajanja bez provođenja novog postupka javne nabave ako su kumulativno ispunjeni sljedeći uvjeti:

1. do potrebe za izmjenom došlo je zbog okolnosti koje pažljiv javni naručitelj nije mogao predvidjeti

2. izmjenom se ne mijenja cjelokupna priroda ugovora

3. svako povećanje cijene nije veće od 30 % vrijednosti prvotnog ugovora, a koje pretpostavke su nesporno i ostvarene.
