6.Nature of the contract:
Fixed price.
7.Contract description:
To provide communication and awareness-raising services under the European Union's Multiannual Indicative Programme for the 2014–2020 period (MIP 2014–2020, for its acronym in English) in El Salvador with a value of 149 000 000 EUR. The MIP focuses on 2 sectors: 1) youth and social inclusion; and 2) private sector development, with funds of 83 000 000 EUR and 61 000 000 EUR being allocated respectively. The services must raise awareness as to the European Union being a partner of El Salvador and include the promotion of other activities forming part of the media support programme, for an amount of 5 000 000 EUR, which also form part of the MIP 2014-2020 and other areas of European Union cooperation in El Salvador.
The communication and awareness-raising activities shall include coordinating meetings with the media and interviews, organising events, producing audiovisual materials and promotional and information-giving documents, publishing articles in the written press, as well as other activities to be coordinated with the Delegation of the European Union in El Salvador and the Government of El Salvador, making synergies with actions of the regional cooperation of the European Union for Central America and the representations of the European Union Member States in this country. These activities shall mainly focus on repercussions and impacts of European Union cooperation and will need to continue throughout the action's whole life cycle. Amongst his other responsibilities the contractor will need to guarantee that a coordinator will be present in El Salvador over the contract period, arrange coordination meetings with the institutions involved and draw up reports on activity performance.

9.Maximum budget:
1 225 000 EUR.
10.Scope for additional services:
The contracting authority, if it deems necessary, will be able to extend the project in duration and/or scope, subject to the availability of funding, up to a maximum not exceeding the length and value of the initial contract. Any extension of the contract would be subject to satisfactory performance by the contractor.


Conditions for participation

11.Eligibility:

Participation is open to natural persons and legal entities (individually or grouped together in a tenderers' consortium) established in a Member State of the European Union or in an eligible country or territory as defined in Regulation (EU) No 236/2014 of the European Parliament and of the Council of 11.3.2014 laying down common rules and procedures for the implementation of the Union's instruments for financing external action (http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=OJ:L:2014:077:0095:0108:ES:PDF), for the instrument under which the contract is financed (see also point 29 below). International organisations may also take part.

12.Application:
Natural persons or legal entities who are eligible (see point 11 above) or groupings of said parties (consortia) may take part in the invitation to tender.
A consortium can be a permanent grouping with a legal status or an informal grouping created for a particular invitation to tender. All the members of a consortium (i.e. the leader and all other partners) are to be jointly and severally liable vis-à-vis the contracting authority.
Should a natural person or legal entity not meeting the eligibility criteria take part (see point 11), the party concerned will be automatically disqualified. Furthermore, should said party belong to a consortium, the whole consortium will be excluded.
13.Number of applications:
Natural persons and legal entities can only submit 1 application, irrespective of the form their participation may take (as sole legal entity or as leader or partner in a consortium submitting an application). Should a natural person or legal entity submit more than 1 application, all the applications involving said party will be rejected.
14.Prohibition on alliances between shortlisted candidates:

Any tenders received from tenderers which include firms not mentioned on the shortlisted application forms will be excluded from this restricted tender procedure, unless prior approval from the contracting authority has been obtained (see the Practical Guide — PRAG 2.4.3 (http://ec.europa.eu/europeaid/prag/?header_description=DEVCO+Prag+to+financial+and+contractual+procedures+applicable+to+external+actions+financed+from+the+general+budget+of+the+EU+and+from+the+11th+EDF&header_keywords=ePrag,+europa)). Shortlisted candidates may not form alliances or subcontract to each other for this contract.

15.Grounds for exclusion:
As part of the application form, candidates must submit a signed declaration, included in the standard application form, confirming that they are not in any of the exclusion situations listed in section 2.3.3 of the Practical Guide.
16.Subcontracting:
Subcontracting is permitted.
17.Number of candidates to be shortlisted:
Between 4 and 8 candidates will be invited to submit detailed tenders for this contract, depending on the applications received. If the number of eligible candidates meeting the selection criteria is less than the minimum of 4, the contracting authority may invite those candidates meeting said criteria to submit a tender.

Selection and award criteria

21.Selection criteria:
The following selection criteria will be applied to tenderers. Where applications are from a consortium, these criteria will apply to the consortium as a whole. The selection criteria will not be applied to natural persons or one-man businesses when they are subcontractors.
1) Candidate's economic and financial capacity (based on section 3 of the application form). Where the tenderer is a public body, equivalent information must be provided. The reference period that will be taken into account will be the past 3 financial years for which closed accounts are available:
Criteria for natural persons and legal entities:
1. the candidate's annual turnover for the years 2013, 2014 and 2015 must have been 4 times the maximum annualised budget for the contract, i.e. over 1 225 000 EUR.
2. The financial liquidity ratio (current assets/current liabilities) at the end of the last financial year for which accounts have been closed must be at least equal to 1. In the case of a consortium, each of its members must comply with this criterion.
2) Candidate's professional capacity (based on sections 4 and 5 of the application form). The reference period that will be taken into account will be the 3 years prior to the submission deadline:
Criteria for natural persons and legal entities:
1. the candidate must have at least 10 employees currently working on a permanent basis in technical and scientific fields related to the nature of the project.
2. At least 20 % of the staff working this year for the candidate in fields related to this contract must be on permanent contracts.
3) Candidate's technical capacity (based on sections 5 and 6 of the application form). The reference period that will be taken into account will be the 3 years prior to the submission deadline:
Criteria for natural persons and legal entities:
1. the candidate must have provided services under at least 2 contracts, where the annual budget for each one was at least 300 000 EUR, in technical fields related to those of this contract, such as devising and implementing communication and awareness-raising activities for cooperation projects or projects related to these issues, which were carried out (or are ongoing) at any time during the reference period: 2013, 2014 and 2015.
Prior experience involving a breach of contract and termination thereof by the contracting authority cannot be used as a reference.
An economic operator may, where appropriate and for a particular contract, rely on the capacities of other entities, regardless of the legal nature of the links which it has therewith. In such an event, it must provide the contracting authority with evidence that the resources needed for performance of the contract are available to it, for example, by submitting an agreement from such entities to provide said resources. Such entities, for instance the parent company of the economic operator, must respect the same rules of eligibility and notably that of nationality, as the economic operator.
If more than 8 candidates prove to be eligible, i.e. meet all the aforementioned selection criteria, the respective strengths and weaknesses of their applications will be re-examined in order to select the 8 most suitable candidates. The only factor that will be taken into account during this re-examination will be the number of man-months in contracts in fields related to this contract, i.e. devising and implementing communication and awareness-raising activities for development cooperation projects, in Latin America.

The envelope containing the application must be clearly marked with the contract title and the publication reference (see point 1 above). These must also be quoted in all subsequent correspondence with the contracting authority.
Applications sent in any way other than this will not be considered.
When they submit their application, candidates agree to receive notification of the results of the procedure via electronic means. This notification shall be considered received by the candidate on the date on which the contracting authority sent said notification to the e-mail address stated in the application.
26.Amendments to, or withdrawal of, applications:
Candidates may give notice in writing before the deadline for submission of applications that they intend amending or withdrawing their application. Applications may not be amended after this deadline.
Any notification of amendment or withdrawal must be submitted in accordance with point 25. The word 'Modificación' (amendment) or 'Retirada' (withdrawal), as applicable, must be written clearly on the outside envelope (and on the corresponding inside envelope).
27.Operational language:
All correspondence concerning this invitation to tender procedure and contract must be in Spanish.
