VII.1.4)Description of the procurement:

Espoon kaupungin ja Oy Göran Hagelberg Ab:n välistä sopimusta jatketaan sopimuksen voimassaolon osalta enintään 31.12.2022 saakka.

Julkisista hankinnoista ja käyttöoikeussopimuksista annetun lain (”hankintalaki”) 136 § 2 momentin 2 kohdan mukaan hankintasopimukseen voidaan tehdä muutos ilman uutta hankintamenettelyä, jos alkuperäisen sopimuskumppanin on tarpeen suorittaa lisätöitä tai -palveluja taikka ylimääräisiä tavarantoimituksia, jotka eivät sisältyneet alkuperäiseen sopimukseen, ja jos sopimuskumppanin vaihtaminen ei ole mahdollista taloudellisista tai teknisistä syistä ja aiheuttaisi merkittävää haittaa tai kustannusten merkittävää päällekkäisyyttä hankintayksikölle eikä vaikuta sopimuksen yleiseen luonteeseen.

Lisäksi hankintalain 136 § 3 momentissa todetaan, että ”edellä 2 momentin 2 kohdassa tarkoitetun muutoksen arvo ei saa olla enemmän kuin 50 prosenttia alkuperäisen sopimuksen arvosta. Jos 2 momentin 2 kohdassa tarkoitettuja muutoksia tehdään peräkkäin useampia, arvioidaan jokaista muutosta itsenäisenä. Tällaisten muutosten tavoitteena ei saa olla tämän lain säännösten kiertäminen.”.

Espoon kaupunki tarvitsee lisätavarantoimituksia ja niihin liittyviä lisäpalveluita alkuperäisiltä puitejärjestelyn sopimuskumppaneilta, koska aikainen lumeton talvi on liukkauden vuoksi vaatinut enemmän liukkaudentorjuntamateriaaleja ja niiden varastot ovat nopeasti ehtyneet. Lisähankinnat eivät sisältyneet alkuperäiseen sopimukseen. Sopimusmuutoksen arvo ei ylitä 50 prosenttia alkuperäisen puitejärjestelyn arvosta.
