THIS IS A NOTICE OF INTENT TO AWARD A SOLE-SOURCE CONTRACT AND IS NOT A REQUEST FOR COMPETITIVE PROPOSALS.  A solicitation document will not be issued and quotations will not be requested.

Authority

This acquisition is being conducted under the authority of FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirement.

Background and Description

The Department of Education’s (the Department) Office of Finance and Operations (OFO) utilizes Fiserv’s Windows based reconciliations software application known as Frontier. OFO has used the Frontier application (formerly Check Free) along with several upgrades since 1999. Frontier provides an enterprise-wide reconciliation framework that includes reconciling the Department's most significant non-credit reform accounts and Fund Balances with Treasury. The Frontier application is a critical part of the Department’s financial management operations and is essential for meeting multiple statutory and regulatory requirements, including the CFO Act; the Manager’s Financial Integrity Act; and the annual audit of the Department’s financial statements. To continue using the software, it is necessary to renew the subscription and support for the product. 

Sole Source Determination

As a result, the Department intends to negotiate on a sole source basis, IAW Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 as implemented by FAR Subpart 13.5, with Fiserv Federal Syatems, Inc (Fiserv) for the to continuation of software support and maintenance for the remainder of the software’s life with the Department. Because of the proprietary nature of the software, only Fiserv, the original software manufacturer, can provide the subscription and support for the Frontier software. Fiserv does not authorize the resale of its maintenance agreements and therefore, they are the only vendor is capable of meeting the Government’s needs.

Interested parties that believe they could satisfy the requirements described in the SOW may clearly and unambiguously identify their capability to do so in writing by or before the response date for this notice. This notice of intent is not a solicitation.
