1. To the best of our knowledge, and having looked into the matter thoroughly, Clarus is the only provider of CCP activity data and SEF activity data including the full list of metrics and breakdowns, as well as the worldwide coverage described in the functional requirements and required to our work for monitoring CCP activity as detailed in the above section. We do not have access to this kind of data from other commercial providers, nor via regulatory data;

2. In addition to our experience using Clarus products during which we have not come across any relevant alternative commercial data provider, the following checks have been performed and did not exhibit any suitable candidate that would meet the all of our technical requirements: in particular, Clarus is the only data provider that was found covering all major CCPs, major currencies and major types of derivatives worldwide all at once; the other potential providers often focusing on a single CCP.

For these reasons and in accordance with the Point 11.1.b.ii of Annex 1 of the Financial Regulation, which states that the use of a negotiated procedure without prior publication of a contract may be requested where the contract can be awarded only to a particular economic operator, we would like to subscribe to Clarus CCPView and SEFView services for a duration of up to four years including potential renewals.
