Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Mit Vorlage der rechtsverbindlichen Planfeststellung im Jahre 2015 und mit der Baufreigabe waren die Rahmenbedingungen gegeben, das Projekt Ortsumgehung Pirna fortzusetzen. DEGES und die Ingenieurgemeinschaft haben sich dahingehend vereinbart, dass der bestehende Vertrag fortgesetzt wird und dabei auf die veränderten Rahmenbedingungen (späterer Baubeginn, Änderung der gesetzlichen Rahmenbedingungen in Bezug auf die HOAI, veränderte Marktlage insbesondere hinsichtlich der Baupreise und der zur Verfügung stehenden Kapazitäten in der Planung und Bauausführung usw.) angepasst wird. Im Hauptvertrag aus dem Jahr 2010 ist eine Reihe von Leistungen nicht erfasst, die heute zum üblichen Standardleistungsumfang bei den besonderen Leistungen gehört. Das betrifft beispielsweise die Teilleistung Kostenfeststellung und Kostenkontrolle.
