Σύμφωνα με την υπ' αριθμ. 010/2021-1660 Απόφαση Δ.Σ. του ΕΚΕΦΕ 'Δ', με την οποία έγινε δεκτό το άιτημα του Αναδόχου για μετάθεση του χρόνου εκτέλεσης της σύμβασης για λόγους που σχετιζονται με καθυστερήσεις της παραγωγής εξαιτίας της πανδημίας της νόσου Covid19, βάσει της παραγράφου Γ «Συμβάσεις που ΔΕΝ σχετίζονται με την αντιμετώπιση του κορωνοϊού» της Κατευθυντήριας οδηγίας 24 ( (Απόφαση 01/15-04-2020 της Ενιαίας Ανεξάρτητης Αρχής Δημοσίων Συμβάσεων) (ΑΔΑ: ΨΟΗ0ΟΞΤΒ-ΦΔ7) και συγκεκριμένα την περίπτωση δ της παραγράφου 3 «χορήγηση παράτασης κάθε είδους συμβατικών προθεσμιών» και το εγγραφο της Ενιαίας Ανεξάρτητης Αρχής Δημοσίων Συμβάσεων «Ε.Α.Α.ΔΗ.ΣΥ.» με ΑΔΑ ΨΘΘΞΟΞΤΒ-ΒΨ1 βάσει του οποίου η πανδημία COVID-19 αναγνωρίζεται ως συνιστώσα ανωτέρα βία.
