VII.2.2)Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Eladó 2022.03.16-án kelt levelében tájékoztatta Vevőt a habzásgátlószer árának, az elmúlt egy év során bekövetkezett többszöri gyártói áremeléséről.

Az áremelést az alapanyagok jelentős növekedésével, valamint az energia, a gyártási, a szállítási és csomagolási költségek szintén számottevő növekedésével indokolta. Eladó leveléhez csatolta a gyártó elmúlt 12 hónap során bejelentett áremeléseit, amely az elmúlt év során 22% jelent. Eladó 19,5%-os nettó egységár emelést javasol.

Eladó indoklásában jelezte továbbá azt is, hogy, az alapszerződés 2021.02.19.-i megkötése óta a szállítandó termék egységárát azóta sem módosította az ezen időszak alatt bekövetkezett a vegyiparban zajló áremelkedéseket nem hárította át Vevőre.

A szerződés jelen szerződésmódosítással nem érintett pontjai változatlan tartalommal továbbra is hatályban maradnak.

A jelen szerződésmódosításra a 2015. évi CXLIII. törvény (Kbt.) 141. § (4) bekezdés c) pontja került sor.
