VII.2.2)Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

A szerződés módosítására a Kbt. 141. § (6) bekezdése alapján kerül sor, figyelemmel arra, hogy az alábbiak szerint a módosítás nem lényeges:

- a módosítás nem határoz meg olyan feltételeket, amelyek, ha szerepeltek volna a szerződéskötést megelőző közbeszerzési eljárásban, akkor az eredetileg részt vett ajánlattevőkön kívül más ajánlattevők részvételét vagy a nyertes ajánlat helyett másik ajánlat nyertességét lehetővé tették volna, mivel a módosítás nem változtat az eljárásban meghatározott feltételeken, mindössze arra irányul, hogy az opciós időszakra irányuló, Szerződő által megteendő nyilatkozat Biztosítóhoz történő beérkezési határideje csökken;

- a módosítás a szerződés gazdasági egyensúlyát nem változtatja meg a nyertes ajánlattevő javára, nem változik a szerződés ellenértéke, illetve a módosítás nem ütközik a Kbt. 142. § (3) bekezdésében meghatározott tilalomba;

- a módosítás a szerződés tárgyát az eredeti szerződésben foglalt ajánlattevői kötelezettséghez képest nem terjeszti ki jelentősen új elemre, a módosítás a szerződés tárgyát egyáltalán nem változtatja meg, a műszaki tartalom nem változik, pusztán az opciós időszakra irányuló, Szerződő által megteendő nyilatkozat Biztosítóhoz történő beérkezési határideje csökken.
