Különböző belföldi napilapok, folyóiratok szállítása - kalkulált 180 féle sajtótermék nettó 72 258 538,- Ft keretösszeg erejéig 12 hónap időtartamra, a szerződés során felmerülő igények alapján az írásbeli megrendelések szerint. A közbeszerzési dokumentumokban megadott mennyiségi adatok kalkulált adatok, tájékoztató jellegű információnak minősülnek. Ajánlatkérő a „Speciális sajtótermékek” előírás alatt a „Katalógus tábla” 1-180. sorszámon megadott sajtótermékeket érti. Részletes leírás az egyéb közbeszerzési dokumentumok részét képező „Műszaki leírás”-ban és „Katalógus tábla”-ban foglaltak szerint.

VII.2)Information about modifications

VII.2.2)Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

A Kbt. 141. § (4) bekezdés c) pontjának ca) alpontja szerint a módosítást olyan körülmények tették szükségessé, amelyeket Megrendelő kellő gondossággal eljárva sem láthatott előre.

Az azonos tárgyú, 2021. július 1. napjától hatályos korábbi keretszerződés alapján mintegy 679 db sajtótermék éves előfizetésére került sor. A jelen Szerződés megkötését megelőző közbeszerzési eljárás során az újabb ellátott intézmények részéről várható igénynövekedésre tekintettel 1162 db éves sajtótermék előfizetést jelöltünk meg, tehát az előző keretszerződés alapján beszerzett mennyiséget becsült értékét közel megkétszereztük.

A sajtótermék ellátási (SELL) portálon a 2022. I. negyedévre vonatkozó 2021. november 22. és december 6. közötti „rendelési időszakban” az intézményi ellátottak ehhez képest azonban 1764 db éves sajtótermék előfizetésre adtak le igénybejelentést. A közbeszerzési eljárás ezen szakaszában ezen igénynövekedés már nem volt orvosolható, mivel a Szerződés 2021. december 2-án már megkötésre került, ezért annak érdekében, hogy eleget tudjunk tenni a 250/2014. (X.2.) Kormányrendeletben rögzített ellátási kötelezettségünknek, szükséges a Szerződés módosítása.

A Kbt. 141. § (4) bekezdés c) pontjának cb) alpontja szerint a módosítás nem változtatja meg a szerződés általános jellegét, miszerint sem a Szerződés tárgyában, sem a műszaki leírásban szereplő feladatokban nem történik változás a módosítást követően.

A Kbt. 141. § (4) bekezdés c) pontjának cc) alpontja szerint az ellenérték növekedése nem haladja meg az eredeti szerződés értékének 50%-át.
