VII.2)Information about modifications

VII.2.2)Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

A szerződésmódosítás jogalapja a közszolgáltatók közbeszerzéseire vonatkozó sajátos közbeszerzési szabályokról szóló 307/2015. (X. 27.) Korm. rendelet 22. § (2) bekezdés b) pontja.

Figyelembe véve a tárgyi szerződés közszolgáltatói minőségét, a 307/2015. k.r a közszolgáltatók közbeszerzéseire vonatkozó sajátos közbeszerzési szabályok alkalmazása elengedhetetlen. A k.r 22. §-a kifejezett rendelkezése értelmében a Kbt. 141. § (4) c) pontja, mely klasszikus ajánlatkérői minőségben való szerződéskötés esetén a szerződésmódosítás jogalapjául szolgálna, nem alkalmazandó. Fentiekre tekintettel a Kbt. 141. § szerinti jogcím megjelölése ellent mondana a k. r.-nek.

A módosítást olyan körülmény tette elengedhetetlenné, mely előre nem látható volt. A COVID járvány miatt a diákfoglalkoztatás felfüggesztésre, korlátozásra került 14 hónapon keresztül.

A leállítás, korlátozás miatt a tervezett foglalkoztatás csak töredéke került felhasználásra.

Tekintettel arra, hogy csak a szerződés időtartama módosul, egyéb módosításra nem kerül sor, a szerződés jellege nem változik meg.

Ajánlatkérő a szerződés megkötésekor nem láthatta előre, hogy a szerződés időtartama alatt olyan kormányzati védelmi intézkedések kerülnek bevezetésre, melyek a szerződés tárgyát -a diákmunkások foglalkoztatását- korlátozzák, illetve teljes mértékben leállásra kényszerítik.
