VII.2)Information about modifications

VII.2.2)Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

I.2. Eladó a szerződés megkötését követően, 2021. július 19., 20., 21., 22. és 23. napján, a COVID19 új koronavírus járványra hivatkozással akadályoztatást jelentett be, amely akadályok így a szerződés szerinti, a szerződés hatályba lépésétől számított 55 napos Teljesítési Határidő 153 napra növekedését eredményezték.

I.3. Vevő megalapozottnak találta az Eladó akadályoztatásra történt hivatkozását és a szerződés 12. pontjának megfelelően, elfogadta a szerződéses Teljesítési Határidő az akadályoztatás időtartamával történt meghosszabbodását.

II.1. Felek rögzítik, hogy a szerződés-módosítás alapján az ellenérték változására nem kerül sor, továbbá

„ca) a módosítást olyan körülmények tették szükségessé, amelyeket az ajánlatkérő kellő gondossággal eljárva nem láthatott előre;

cb) a módosítás nem változtatja meg a szerződés általános jellegét;

cc) az ellenérték növekedése nem haladja meg az eredeti szerződés értékének 50%-át.”,

így a szerződés-módosítás megfelel a Kbt. 141. § (4) bekezdés c) pont rendelkezéseinek.

Az Eladó által bejelentett akadályoztatások a COVID19 új koronavírus járvány miatt az ellátási láncokban bekövetkezett hiányokra, illetve késedelmekre és a munkaerő megbetegedéseire vezethetőek vissza. A Vevő, mint ajánlatkérő a szerződés 12. pontjában, a Feleken kívül álló okokból történő Teljesítési Határidő hosszabbítás lehetőségét biztosította 30 napra, azonban azt, hogy a járvány okozta ellátási nehézségek ilyen mértékűek lesznek és ilyen mértékben megnövelik a teljesítés időtartamát, kellő gondosság mellett sem láthatta előre.
