Support Maintenance and Upgrade of Dublin Region Telemetry System
Pursuant to a contract notice published in the Official Journal of the European Union on 3 August 2008 (2008/S106-142373), Dublin City Council advertised a single party framework agreement for the maintenance, support, and enhancement of the Dublin Region Telemetry System (DRTS).
The estimated value of contracts to be awarded under the 5 years Framework was €2.9m (excl. VAT). Metasphere was appointed to the Framework Agreement.
— on 1 October 2013, Dublin City Council awarded a call off contract to Metasphere for telemetry system maintenance and equipment supply.
— on 7 December 2016, this contract was novated to Irish Water and extended for a 12 month period to 31 December 2017.
The scope of the contract is to provide continuing enhancement, support, and maintenance for the Metasphere applications required to support the telemetry system.

The figure of €2.9m at Section V.2.4 above represents the initial total estimated spend under the Framework Agreement (see Section II.1.4 of the OJEU notice referenced at Section IV above).
The current spend (to October 2017) under the Framework Agreement is approx. €1.7 million.
The estimated duration of the contract (at VII.1.4 below) is 12 months with the option to extend until such time as a new contract is awarded and the migration of the existing system to the new system has occurred.
Section VII: Modifications to the contract/concession
On 8 June 2017, Irish Water advertised a new contract for the provision and maintenance of a national telemetry(master station) system. This new system will replace the existing Metasphere system.
The tender process is ongoing. Irish Water has a current requirement for additional telemetry instrumentation and associated support and maintenance in order to ensure the continued and safe operation and maintenance of the DRTS until the ongoing tender process is concluded and the new contract is awarded.
The telemetry system provides critical real-time data on flows and pressure across Dublin City and Region.
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
— on 7 December 2016, the contract was novated to Irish Water and extended for a 12 month period to 31 December 2017.
— Irish Water has a current requirement for additional telemetry instrumentation and associatedsupport and maintenance services in order to ensure the continued and safe operation and maintenance ofthe DRTS until such time as a new contract is awarded.
— in addition, Irish Water has extended the contract to 31 December 2018 with the further option to extend until such time as the new contract is in place and the migration of the existing system to the new system has occurred. It is estimated that the migration may take upto 18 months.
Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:
— the telemetry system provides critical real-time data on flows and pressure across Dublin City and Region.
— due to exclusive intellectual property rights, no other entity is capable of providing the required maintenance services, and instrumentation.
— as outlined above, an ongoing tender process is currently being run on a new system and it envisaged that the outcome of the new tender process will be known in 2018.
— it would be technically impossible to develop an interim system while the new system is being tendered and at the very least would cause significant inconvenience or substantial duplication of costs for Irish Water.
