Foynes Jetty Extension Tubular Piles
This is notification of award following a VEAT notice previously published of the intention to award a contract to HDM Tubes Ltd for the purchase of tubular piles fabricated to the specification for the Foynes Jetty Extension project.
As part of the Jetty Extension Project, the first shipment of piles was delivered to Foynes port under a previous procurement that was subsequently abandoned between the parties.
The supplier approached SFPC to negotiate the purchase of the tubular piles at a considerably lower price than normal market value.

Section IV: Procedure
SFPC requires the tubular piles for the extension of the Jetty at Foynes Port, Co. Limerick. The tubular piles were part of the scope of work on a procurement (Ref No 2020/S 144-355583). This procurement was abandoned by the parties.
Pursuant to the Regulations, a utility may negotiate without a call for competition in order to take advantage of particularly advantageous offers in the market place. Regulation 49(1) (h) states:
‘where it is possible to procure supplies by taking advantage of a particularly advantageous opportunity available for a very short time at a price considerably lower than normal market prices:’
The reasons that SFPC consider this provision to be applicable to this procurement is as follows:
• the supplier has issued a time limited proposal to SFPC of considerably lower than market value;
• the order has been fabricated to the specification of Foynes Jetty Extension project;
• the first of two equal orders of tubular piles were shipped and delivered and are now stored at Foynes Port.
