The resulting task order award will be against Indefinite Delivery, Indefinite Quantity contract VA797H-17-D-0022, a mandatory use contract for procuring preventive maintenance and corrective repairs on the Southern AZ VA Health Care System's Philips Digital Diagnostic equipment.

The contractor, Philips Healthcare has intellectual property rights and proprietary data restrictions (security features) that prevent other contractors from servicing Philips Healthcare diagnostic digital equipment properly without subjecting equipment to potential damage. Market Research has revealed Philips has proprietary diagnostic digital equipment, and no other parties are authorized to provide preventive maintenance service, or corrective repair without violating the terms and conditions of their equipment warranty.  Currently the equipment is under warranty as long as it is serviced by licensed Philips Healthcare contractors. Philips Healthcare currently deploys maintenance field technicians under the contract agreement with the VA National Acquisition Center contract # VA797H-17-D- 0022 which ensures equipment is kept and maintained in accordance with Original Equipment Manufacturer standards. Any services performed by non-Philips contractors would effectively void current warranties on the Philips Healthcare equipment.  This is a special notice of intent to Sole Source and will be posted on SAM.gov for 10 days. If this effort does not yield any additional sources that can meet the government requirements a sole source award will be made. Based on the current equipment warranty and proprietary rights issues associated with services from a Non-Original Equipment Manufacturer the decision was made to only consider the original manufacturer for the required maintenance.
