Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below

The works, supplies or services can be provided only by a particular economic operator for the following reason:
- absence of competition for technical reasons

Explanation:

Directive 2014/24/EU of the European Parliament and of the Council Article 32 Clause 2 (b) (ii)

The Economic Operator (EO) works exclusively in issues dealing with innovation and technology and also has hands-on experience

working within the industry, Authorities. Thus, the standing, skillset, experience, expertise and knowledge, which the EO possesses are

unique, even for European standards. The EO has been instrumental in setting up the MDIA, the enabling policy and legislation as well as

the operative guidelines since he was involved with the Authority even before its official inception.

As an Authority, we cannot resort to a Call for Tender process or an Expression of Interest due to the lack of sectorial knowledge in this

specific and highly sought domain as well as the spread of multi-faceted experience and track record which is uniquely provided by EO.

If there are any other individuals thatthe Authority knows of and possess similar talents, MDIA would be eager to engage them since, for

the past three (3) years, we were always on the lookout to recruit such people and also issued calls to this extent; however, we have never

managed to find the same level of knowledge, skillset and expertise we found in EO.
