Although this was not attributable to EASO, a certain requirement stemming from Maltese national law could have been reflected in the Tender Specifications Part 1: Administrative specifications, Section 3.2.1. ‘Legal and regulatory capacity’ in a more unequivocal manner. This concerns the requirement for the tenderers to be licensed as ‘Destination Management Company’ under Chapter 409 of the Malta Travel and Tourism Services Act in order to perform services under the framework contract concerned. As result thereof, it seems that the tenderers may not have been able to evaluate their own suitability in the most extensive manner, which might potentially have resulted in distortion of competition or unequal treatment of tenderers.

The tender procedure shall be re-launched, with updated procurement documents including an explicit reference to the requirement for the tenderers to be licensed as Destination Management Company under Chapter 409 of the Malta Travel and Tourism Services Act in order to perform services under the framework contract concerned.
