INVITATION FOR TENDERS

MONTENEGRO

Supervision of supply and installation of water supply pipeline in the streets Mojkovacka and Bajicka - Cetinje

“Vodovod i kanalizacija-Cetinje“ Ltd, hereinafter referred to as “the Client”, intends to exploit the loan of the European Investment Bank (‘The Bank’), MNE “Water and sanitation“ No. 2005-0221, for the Supervision of supply and installation of water supply pipeline in the streets Mojkovacka and Bajicka - Cetinje.

Maximum budget allocated for this procurement is 45.000 Euro (forty five thousands euro) excluding VAT.

The Client now invites sealed tenders from Consultants for the following contract:

Supervision of supply and installation of water supply pipeline in the streets Mojkovacka and Bajicka - Cetinje

General description:

The Works contract will include reconstruction and construction of water supply pipelines, in the approximate length of 3,5 km, based on the detailed designs for reconstruction of water supply installations in the streets Mojkovacka and Bajicka in Cetinje (2017). In order to build water supply infrastructure, it will be necessary to carry out works on the relocation of existing electrical installations in these streets, as well as installation of electronic communication infrastructure.

The Engineer’s services during the contract period will include but will not be limited to:

— Overall day-to-day supervision, management, cost and quality control, reporting monitoring physical and financial progress of the works contract and related activities;

— Checking and approval of all the documents prepared by the Contractor, to enable the Client to obtain all permits related to preparation for construction Works in accordance with the Montenegrin Law on Planning and Construction published in the Official Gazette No 51/2008 with addenda;

— Prepare monthly progress reports in accordance with the conditions of the works contract in addition to the interim and final reports;

— Review the Contractor’s invoices, variation orders, taking-over certificates, performance certificates and others;

— Review and approve the Contractor’s insurance policies;

— Review and approve the testing plans, performance test and commissioning plans in accordance with the Particular Conditions of the works contract;

— Assist the Municipality to resolve disputes as they arise and, should a dispute become intractable, assist the Municipality to compile all necessary reports, documents and evidence needed for presenting its claim to arbitration;

— Monitor and verify that the contractor complies with the requirements of laws and regulations governing construction of works in Montenegro;

— Keep Construction Site Records;

— Technical assistance during Defects Notification Period.

The Engineer shall set up a supervisory organization including monitoring systems to ensure a fast and efficient administration of the activities, a timely implementation of the works and an efficient use of the financial resources.

The Engineer shall work closely with the “Vodovod i kanalizacija-Cetinje“ Ltd, Old Royal Capital Cetinje, National Project Implementation Unit in the Field of Communal Services and Environment (PROCON) and Ministry of Sustainable Development and Tourism, in particular on contractual issues, concerning project progress and costs.

Tendering for contracts to be financed with the proceeds of the European investment bank is open to firms from any country.

To be qualified for the award of a contract, tenderers must satisfy the following minimum criteria (Note: Qualification criteria and submission of proof are described in more details in the tender documents):

A) General

1. Eligibility Criteria

- Tenderer shall not have a conflict of interest. All Tenderers found to have a conflict of interest shall be disqualified.

- Tenderer shall be disqualified if the Tenderer, an affiliate of the Tenderer, a party constituting the Tenderer or an affiliate of a party constituting the Tenderer, is under a declaration of ineligibility by the Bank, at the date of the deadline for Tender submission or thereafter, as well as if having been excluded as a result of the Borrower’s country laws or official country regulations, or by an act of compliance with UN Security Council resolution.

- No affiliate of the Client shall be eligible to tender or participate in a tender in any capacity whatsoever unless it can be demonstrated that there is not a significant degree of common ownership, influence or control amongst the affiliate and the Client.

2. Historical Non-performance. A consistent history of historical non-performance and/or litigation awards against the Tenderer or any partner of a joint venture may result in rejection of the tender.

B) Financial Capacity

1. The candidate should have a minimum average annual turnover (defined as billing for supervision of works in progress and completed) over the last 3 (three) financially closed years of not less than EUR 90.000 (ninety thousand euro).

2. The Tenderer shall demonstrate that it has access to, or has available, lines of credit, and other financial means sufficient to support the cash flow demands for the contract, estimated as not less than EUR 25,000 (twenty five thousands) equivalent, taking into account the applicant's commitments for other contracts.

C) Technical and Professional Capacity - contract references

0. The tenderer must be a registered firm or natural person legally capable of carrying out the specified services.

1. The tenderer has provided services under at least 2 (two) service contracts for supervision of water supply system/water distribution pipeline or sewerage system, during the 5 years period prior to the submission deadline.

2. The tenderer (individual company or consortium) has successfully completed supervision of at least 1 (one) FIDIC Yellow or FIDIC Red Book contract relevant to the construction of water supply system or sewerage network system, which was implemented (the Taking Over Certificate issued) at any moment during the 5 years period prior to the submission deadline.

D) Technical and Professional Capacity - personnel references

1. The candidate should have at least 4 (four) permanently employed university graduated engineers with university qualifications relevant to this assignment. The university graduated engineers have to be employed in the candidate’s company at least 1 (one) year prior to the deadline of submission of proposals.

2. The candidate shall guarantee the following Key experts: Project manager, Site manager, Civil Hydraulic Engineer, Electrical Engineer (high voltage), Electrical Engineer (low voltage) and Geodetic Surveyor.

3. The candidate should demonstrate a back-up capacity of the permanently employed university graduated engineers.

Note: At the moment of Contract signing (or the latest on the Commencement Date) the Experts will have to possess a professional licence(s), certificate(s) (or right), in accordance with the relevant legislation of Montenegro. All relevant expenses (for the above Personnel, as well as for all other staff which will be involved in the project implementation) are deemed to be included in the tender price.
