Bergen kommune [Bergen Municipality] intends to enter into a contract with Telia Norge AS concerning delivery of services to TV and information screens in Bergen kommune [Bergen Municipality].

Services included in this contract are:

1) Operation and administration of a main TV central.

2) Establishment of a solution for TV and information screens in accordance with orders.

3) Operation, administration and support.

II.2.4)Description of the procurement:

Bergen Municipality already has a contract with Telia Norge AS for delivery of services to data communication and telephony (DT contract), that expires 27 June 2025. Telia can deliver the service on their own, already existing infrastructure as a result of the DT contract. If another supplier shall deliver a similar solution, the supplier must either provide infrastructure to the entities or Bergen Municipality must pay for sufficient internet capacity for this purpose. Since it is possible for Telia to utilise their own, existing infrastructure for delivery of the new service, it is not relevant that Bergen Municipality pays the extra costs for special internet capacity for this purpose.

Due to the significant additional costs that would accrue for suppliers, other than Telia, to delivery infrastructure to the entities, it is unlikely that other suppliers would be able to win this contract in competition with Telia. We therefore consider it unnecessary use of time and resources to hold a contest, ref. also to the Procurement Act's purpose concerning efficient resource use.

In other words, it is not possible to hold a real competition for this procurement, due to technical reasons, as there ‘are no cheap alternatives’ to Telia, cf. Public Procurement Regulation § 13-4, alternative b, no. 2 and supplementary sentence under alternative b.

The duration of this contract follows the duration of the DT contract with Telia. When the DT contract is re-announced, the services for TV and information screens will also be exposed to competition.

Bergen Municipality published a prior information notice about entry into a contract for services to TV and information screens on Doffin/TED 8 September 2021 and gave a tentative contract date of 17 September. This deadline will be too short for the tenderers, but the prior information notice cannot be revised and therefore a new prior information will be published with a new tentative contract date of 28 September 2021.
