Voluntary Ex-ante Transparency Notice — Framework Agreement for Hiring Resources for the Development of Secure Mobile Communication
The procurement will secure the Norwegian Defence Materiel Aggency a framework agreement for hiring resources for the development of secure mobile communication. This concerns assistance with the development of systems for the Norwegian Armed Forces´ use of commercial mobile technology. The Norwegian Defence Materiel Agency intends to enter into a contract with Analysys Mason AS for the delivery of services within this field.
The Norwegian Defence Materiel Agency, ICT Capacities, would like to enter into a framework agreement for hiring resources for the development of secure mobile communication. This concerns assistance with the development of systems for the Norwegian Armed Forces´ use of commercial mobile technology. The resource/s will, amongst other things, contribute to solving the Norwegian Defence Materiel Agency's project assignment P8031 'Optimisation of videl and speech services', but will not be limited to this assignment.
As a rule, it will not be necessary for the resources to work in the contracting authority's premises, they can carry out the work from their own premises. Tenderers' calculations can be based on the contracting authority always requiring assistance equivalent to between a 30 % and 100 % position.
A non-exclusive framework agreement will be signed with one tenderer.
The framework agreement is an operational and maintenance contract.
The framework agreement's duration is 2 years, with options for 1 + 1 year.
The estimated value of the contract is NOK 2 000 000 — 8 000 000 excluding VAT.

Section IV: Procedure
The procurement will ensure that the Norwegian Defence Materiel Agency has access to resources for the development of secure mobile communication. This concerns assistance with the development of systems for the Norwegian Armed Forces' use of commercial mobile technology. The Norwegian Defence Materiel Agency held an open tender contest in 2019 in accordance with the PPR parts 1 and 3. The only tender that was received in the contest was from Analysys Mason AS. The tender fulfilled all the requirements that were set in the tender documentation, and covered the contracting authority's need for assistance within the field. The Norwegian Defence Materiel Agency signed a contract with Analysys Mason AS, but the framework agreement was limited to project P8031. The Norwegian Defence Materiel Agency now sees that the need for the above-mentioned services is not limited to project P8031, and would, thus, like to change the project limitation. The Norwegian Defence Materiel Agency sees the elimination of the project limitation as insignificant, and believes that the number of potential suppliers for the procurement remains the same. Based on the Norwegian Defence Materiel Agency's knowledge of the market, there are no other suppliers that can provide the requested services. The Norwegian Defence Materiel Agency intends to enter into a contract with Analysys Mason AS for the delivery of services within this field. Based on the above, our assessment is that we have the legal basis to enter into a contract with Analysys Mason AS without a prior tender contest, c.f. PPR Section 13-4, letter b, point 2 (tender contest is impossible for technical reasons). There is only one provider that can cover our requirements.
