Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

W związku z niepodjęciem realizacji usług ochrony w części 1 (Izba Administracji Skarbowej w Katowicach) oraz części 21 (Urząd Skarbowy w Mysłowicach), zgodnie z postanowieniami umowy nr 172/2021 z dnia 26-11-2021r. Pomimo wezwania z wyznaczonym dodatkowym terminem do rozpoczęcia realizacji przedmiotu zamówienia, usługi w obiektach nie podjęto. Nie udzielono także żadnych wyjaśnień dot. zaistniałej sytuacji. Zgodnie z zapisami umowy Zamawiający wypowiedział umowę w części 1 i 21, ze skutkiem natychmiastowym z powodu naruszenia istotnych warunków umowy.
