Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Zamawiający dokonał czasowej (do dnia 30.06.2022 r.) zmian umowy na podstawie art. 455 ust. 1 pkt 1 ustawy PZP w zakresie zwiększenia ustalonych pierwotnie cen jednostkowych za przedmiot zamówienia, ze względu na wystąpienie okoliczności, których działając z należytą starannością, nie mógł przewidzieć w procesie przygotowania postępowania. Okolicznością tą jest nagły i nieprzewidywalny wzrost cen paliw i innych surowców oraz problemy z utrzymaniem łańcucha dostaw, na rynku ogólnoświatowym, będący efektem zewnętrznego zjawiska w postaci wybuchu konfliktu zbrojnego na Ukrainie, co ma bezpośredni wpływ na ceny ustalone pierwotnie w umowie. Dokonana zmiana nie modyfikuje ogólnego charakteru zawartej umowy a przewidziany nią wzrost cen nie przekracza 50% wartości pierwotnej umowy.
