Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Na podstawie art. 455 ust. 1 pkt 4 ustawy z dnia 11.09.2019 r. PZP”), został zawarty aneks nr 1 („Aneks”) następującej treści:w trakcie realizacji Umowy, w następstwie agresji Federacji Rosyjskiej na Republikę Ukrainy, nastąpił gwałtowny wzrost cen paliw płynnych w stosunku do cen obowiązujących w okresie poprzedzającym postępowanie o udzielenie zamówienia publicznego poprzedzające zawarcie Umowy; wzrost cen paliw płynnych, o którym mowa w pkt (I) nastąpił w wymiarze, którego Zamawiający działając z należytą starannością, nie mógł przewidzieć; agresja Federacji Rosyjskiej na Republikę Ukrainy jako zdarzenie będące przyczyną wzrostu cen paliw płynnych, o którym mowa w pkt (I) jest zdarzeniem, którego Zamawiający nie mógł przewidzieć działając z należytą starannością;
