TenneT has in the past concluded framework agreements with several suppliers (Original Equipment Manufacturer – OEM) for the supply, assembly and delivery in working order of Gas Insulated Switchgear (GIS) under the Qualification System “Gas Insulated Switchgear”. Next to having these framework-agreements, TenneT would like to conclude stand-by contracts with these OEM's to ensure that in case of a calamity the original supplier can act expeditiously in order to eliminate such calamity.

TenneT would like to conclude stand-by contracts with the original OEM to prevent issues related to warranty, liability, maintenance and preservation.

Duration(s) and value(s) as mentioned in this modification form are fictive due to the fact it concerns the GIS of a specific OEM which have been installed in the high voltage grid of TenneT TSO B.V.

If your organisation objects to this intended award decision, it must make its objections known to TenneT within 30 calendar days by serving on TenneT a summons for summary proceedings before the competent court. The above-mentioned term of 30 calendar days shall commence on the day after the date on which this notice is published. The term of 30 calendar days must be regarded as a time limit. Upon expiry of this term, TenneT shall consider that it is entitled to finally award the contract and conclude the agreements with the OEM's. If your organisation decides after these 30 calendar days to initiate legal proceedings in connection with TenneT's intended decision to award the contract, TenneT will adopt the position that your organisation has inadmissible claims.
