Naročnik ugotavlja, da ne gre za bistveno spremembo pogodbe v skladu z 1.odstavkom 95.člena ZJN-3, ker so dodatna dela potrebna, čeprav niso bila vključena v prvotno javno naročilo, zamenjava izvajalca pa ni mogoča iz ekonomskih oz. tehničnih razlogov,
