Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Como consecuencia de la resolución número 260/2020 del Tribunal Administrativo de Contratación Pública de la Comunidad de Madrid, queda invalidada la adjudicación aprobada el día 3.7.2020 por el órgano de contratación de Metro de Madrid (BOCM número 168 con fecha 13.7.2020). Con fecha 30.12.2020, el órgano de contratación de Metro de Madrid aprueba la adjudicación del lote B a la UTE Ilunion Limpieza y Medioambiente, S. A. — Ilunion C. E. E. Limpieza y Medioambiente, S. A. por un importe de adjudicación (sin IVA): 9 282 178,44 EUR y una duración del contrato: once meses (desde el 1.3.2021 al 31.1.2022). La ratificación de las adjudicaciones que en relación a los lotes A, C y E de la licitación 6011700106 fueron aprobadas con fecha 2.11.2017, continuando en vigor los contratos correspondientes a estos tres lotes, formalizados con fecha 15 de enero de 2018 y con una duración de cuatro años desde el 1.2.2018 (DOUE 2017/S 212-441594).
