This dynamic purchasing system (DPS) is to establish suitably qualified cycle training providers to deliver Bikeability Scotland on-road cycle training within local authority areas.
The DPS is a 2-stage process. There is no intention to limit the minimum and maximum number of service providers. In the initial setup
Stage, all service providers that meet the selection criteria and are not excluded must be admitted to the DPS.
The DPS will be open to entrants throughout its life who meet the minimum criteria.

Section III: Legal, economic, financial and technical information
In response to ESPD (Scotland) Question 4A.2 where it is required within a bidder’s country of establishment, bidders must confirm which
Authorisation(s) or membership(s) of the relevant organisation(s) are required in order to perform this service(s) to be procured under this
Dynamic purchasing system;
As a minimum bidders must be able to satisfy the Minimum Staffing Requirements: all Lots
Evidence will be provided to the satisfaction of Scotland Excel/a Council as and when requested that all Staff performing the Contract:
— Have completed and passed Cycling Scotland’s four day ‘Cycle Trainer’ course (or any subsequently amended or successor course),
— Have been suitably vetted in accordance with Law and Guidance including the PVG Act allowing them to provide the Service at the designated location/s as set out in the [Dynamic Purchasing System Terms and Conditions and the] Contract Terms and Conditions,
— Have a current basic First Aid qualification/s in accordance with Law and Guidance. This should be an Emergency First Aid at Work (EFAW) or equivalent 6 hour course,
— Delivery must be based on current guidelines and ensure only up to date official Cycling Scotland resources are used,
— Have completed and passed an industry standard ‘Child Protection Training Course’ such as:- UK Coaching Safeguarding and Protecting Children Course (SPC1) or equivalent 3 hour course,
— Must demonstrate ability to lead Bicycle, Helmet, Clothing and Equipment safety checks prior to session delivery. Evidence, such as Cycle Trainer or equivalent qualification,
— Ensure compliance with staff-to-child ratios as agreed with the Council and/or required by Law and Guidance to ensure safe and effective delivery of the training,
— Provide a code of conduct adequately reflecting the requirements of the Service and the Contract for staff for review,
— Offer “Pre-start meetings” to the Council to agree and record in advance all necessary operating procedures relative to the training to be provided including, for example, related to the particular training requirements, the nature of the children or young people involved and the location for the training,
— Require to record training dates, training locations, schools involved, level of training and numbers of pupils both participating and completing course.
Quality Assurance
All Staff performing the Contract will be subject to quality assurance observations. This will be managed by Cycling Scotland’s Quality Assurance Lead Officer. Continued Professional Development
Should changes to the Bikeability Scotland programme occur, all Staff performing the Contract will be expected to attend a mandatory orientation session delivered by Cycling Scotland to ensure changes are understood and enacted during delivery of the Contract.
1) Insurance requirements (ESPD (Scotland) Question 4B.5.1 and ESPD (Scotland) Question 4B.5.2):
It is a requirement of the contracts to be procured under the proposed dynamic purchasing system that bidders hold, or can commit to obtain prior to the commencement of any subsequently awarded contract, the types and levels of insurance indicated below:
All lots:
— employers liability insurance = to a minimum indemnity limit of 10 000 000 GBP, each and every claim, without limit to the number of claims,
— public liability insurance = to a minimum indemnity level of 10 000 000 GBP, each and every claim, without limit to the number of claims,
— third party motor vehicle liability insurance = in accordance with the provisions of the current Road Traffic Act 1988 vehicles used during the delivery of the service must have valid appropriate insurance.
Notwithstanding the minimum Insurance requirements to participate in the contract as set down in this condition, due to the nature of some of the services, the Council may decide to increase the minimum insurance requirements and will indicate as such if applicable via their ITT documents when awarding a contract. In these circumstances the service provider will be allowed the opportunity to arrange to increase its Insurance cover to the level stipulated by the Council and to reflect the increased cost (if any) to provide the services in meeting the increased requirement.
2) Other economic and financial requirements (ESPD (Scotland) Question 4B.6):
A search of the bidder against Equifax’s Protect must not return a ‘Warning‘ or ‘Caution’ returnable code or any neutral code, unless the bidder confirms that it can provide any other documents which Scotland Excel considers appropriate to prove to Scotland Excel (acting within its permitted discretion under the applicable public procurement rules) that the bidder does/would not present an unmanageable risk should it be appointed on to the proposed dynamic purchasing system.
Equifax’s Protect is a fraud indicator/credit risk search and analysis of five areas of threat in relation to a particular company:
— credit history,
— disqualification,
— validation and investigation bureau,
— connected data, and
— bureau information.
1) Relevant examples of previous supplies or services;
2) Subcontracting;
3) Quality management procedures;
4) Health and safety procedures.
In accordance with Regulation 59(12), as this proposed dynamic purchasing system is divided into lots, these technical and professional ability selection criteria apply separately in relation to each individual lot.
1. RELEVANT EXAMPLES OF PREVIOUS SERVICES OR SUPPLIES (ESPD (Scotland) Question 4C.1.2):

The bidder MUST HOLD a UKAS (or equivalent), accredited independent third-party certificate of compliance in accordance with BS
OHSAS 18001 (or equivalent) or have, within the last 12 months, successfully met the assessment of a scheme registered membership of
The Safety Schemes in Procurement (SSIP) forum.
Whilst it is a criteria for suppliers to hold accredited independent third party certificate of compliance in accordance with BS OHSAS 18001 (or equivalent), it is important to note that due to the recent release of ISO 45001, this will now be withdrawn. Therefore, bidders are also required as part of their submission to specify that they will commit to migrate to the new standard by March 2021.

A regularly reviewed and documented policy for Health and Safety management, endorsed by the Chief Executive Officer, or equivalent.
The policy must be relevant to the nature and scale of the work and set out responsibilities for Health and Safety management at all levels

It is likely that Councils will require to collect information relating to key performance indicators (KPI’s) that will be detailed in the relevant invitation to tender document or discussed and agreed at the start of the period of contract and thereafter monitored as part of the management of the contract. Please see conditions of contract Clause 27 for an indication of the KPIs required (unless otherwise agreed for specific procurements under the DPS).
