Wykonawca przyjął do wykonania usługi z zakresu gospodarki leśnej polegające na wykonaniu zamówienia pn. Wykonywanie usług z zakresu gospodarki leśnej na terenie leśnictw Żółno, Karpno i Płocice (Przedmiot Umowy). Zestawienie ilości prac wchodzących w zakres Przedmiotu Umowy, opis standardu technologii wykonawstwa prac leśnych oraz procedury odbioru zostały określone w specyfikacji warunków zamówienia dla Postępowania (SWZ). Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

W trakcie realizacji Umowy, w następstwie agresji Federacji Rosyjskiej na Republikę Ukrainy, nastąpił gwałtowny wzrost cen paliw płynnych w stosunku do cen obowiązujących w okresie poprzedzającym postępowanie o udzielenie zamówienia publicznego poprzedzające zawarcie Umowy. Wzrost cen paliw płynnych nastąpił w wymiarze, którego Zamawiający działając z należytą starannością, nie mógł przewidzieć. Agresja Federacji Rosyjskiej na Republikę Ukrainy jako zdarzenie będące przyczyną wzrostu cen paliw płynnych, o którym mowa powyżej jest zdarzeniem, którego Zamawiający nie mógł przewidzieć działając z należytą starannością.
