6.Nature of the contract:
Fixed-price.
7.Contract description:
To devise and implement a joint European Union-Guatemala public diplomacy strategy for information, communication and dialogue with different parties and partners in the country. This includes research, publications, information campaigns, materials for dissemination, events, digital material, seminars and conferences, as well as media monitoring, analysis of European Union awareness and other activities to help Guatemalan society be sufficiently informed about European Union cooperation.
8.Number and titles of the lots:
1 lot only.
9.Maximum budget:
950 000 EUR.
10.Scope for additional services:
The contracting authority, if it deems it necessary, may extend the project's duration or scope, subject to the availability of funding, up to the the estimated value of approximately 950 000 EUR. Any extension of the contract would be subject to satisfactory performance by the contractor.


Conditions for participation

11.Eligibility:
Participation is open to natural persons and legal entities (individually or grouped together in a tenderers' consortium) established in a Member State of the European Union or in an eligible country or territory as defined in Regulation (EU) No 236/2014 of the European Parliament and of the Council of 11.3.2014 laying down common rules and procedures for the implementation of the Union's instruments for financing external action, for the instrument under which the contract is financed (see also point 29 below). International organisations may also take part.
12.Application:
Natural persons and legal entities who are eligible (see point 11 above) or groupings of said parties (consortia) may take part in the invitation to tender.
A consortium can be a permanent grouping with a legal status or an informal grouping created for a particular invitation to tender. All the members of a consortium (i.e. the lead tenderer and all other partners) are to be jointly and severally liable vis-à-vis the contracting authority.
Should a natural person or legal entity not meeting the eligibility criteria take part (see point 11), the party concerned will be automatically disqualified. Furthermore, should said party belong to a consortium, the whole consortium will be excluded.
13.Number of applications:
Natural persons and legal entities can only submit 1 application, irrespective of the form their participation may take (as the sole legal entity or lead tenderer or partner in a consortium submitting an application). Should a natural person or legal entity submit more than 1 application, all the applications involving said party will be rejected.
14.Prohibition on alliances between shortlisted candidates:
Any tenders received from tenderers which include firms not mentioned on the shortlisted application forms will be excluded from this restricted tender procedure, unless prior approval from the contracting authority has been obtained (see section 2.4.3 of the Practical Guide — PRAG). Shortlisted candidates may not form alliances or subcontract to each other for this contract.
15.Grounds for exclusion:
As part of the application form, candidates must submit a signed declaration, included in the standard application form, confirming that they are not in any of the exclusion situations listed in section 2.3.3 of the Practical Guide.
16.Subcontracting:
Subcontracting is not permitted.
17.Number of candidates to be shortlisted:
Between 4 and 8 candidates will be invited to submit detailed tenders for this contract, depending on the applications received. If the number of eligible candidates meeting the selection criteria is less than the minimum of 4, the contracting authority may invite those candidates meeting said criteria to submit a tender.

Selection and award criteria

21.Selection criteria:
The following selection criteria will apply to tenderers. Where applications are from a consortium, these criteria will apply to the consortium as a whole, unless stated otherwise. The selection criteria will not apply to natural persons and single-member companies working as subcontractors.
1) Candidate's economic and financial capacity (based on section 3 of the application form). Where the tenderer is a public body, equivalent information must be provided. The reference period that will be taken into account will be the past 3 financial years for which closed accounts are available:
1. the candidate's average annual turnover (from 2013 to 2015) must exceed the maximum annual budget of the contract, i.e. the maximum budget stated in the contract notice divided by the initial contract duration in years, where this exceeds 1 year (the required minimum annual turnover cannot be more than twice the estimated annual contract value, except in cases that are duly substantiated in the invitation to tender dossier).
2. average figures for cash and cash equivalents at the beginning and end of 2013, 2014 and 2015 must have been positive.
2) Candidate's professional capacity (based on sections 4 and 5 of the application form). The reference period that will be taken into account will be the 3 years prior to the submission deadline (2013, 2014 and 2015):
(a) at least 20 % of employees must have worked for the candidate in 2014 and 2015 in fields related to this contract; and
(b) at least 20 % of the staff working this year (2016) for the candidate in fields related to this contract must be permanent employees.
3) Candidate's technical capacity (based on sections 5 and 6 of the application form). The reference period that will be taken into account will be the 5 years prior to the submission deadline:
(a) the candidate must have worked satisfactorily on at least 2 contracts with a budget at least equal to that of this contract. Said contracts must have lasted at least 24 months, have been in fields related to this contract and completed in the 5 years prior to the date for submission of applications; and
(b) in the past 5 years (1.1.2011–31.12.2015), the candidate must have successfully completed at least 2 service contracts in the fields of this contract (devising and implementing communication strategies, advising international/multilateral or bilateral bodies and similar or related ones) in Central America, and the percentage carried out must have been at least 50 %.
Prior experience involving a breach of contract and termination thereof by the contracting authority cannot be used as a reference.
An economic operator may, where appropriate and for a particular contract, rely on the capacities of other entities, regardless of the legal nature of the links which it has therewith. In such an event, it must provide the contracting authority with evidence that the resources needed for performance of the contract are available to it, for example, by submitting an agreement from such entities to place said resources at its disposal. Such entities, e.g. the parent company of the economic operator, must respect the same eligibility rules (particularly those regarding nationality) and fulfil the same selection criteria as the economic operator. With regard to the technical and professional criteria, only economic operators may rely on the capacities of other entities if the latter will carry out the works or provide the services for which these capacities are necessary. With regard to the economic and financial criteria, the entities on whose capacities the tenderer will rely shall become jointly and severally liable for contract performance.
If more than 8 candidates prove to be eligible, i.e. meet all the aforementioned selection criteria, the respective strengths and weaknesses of their applications will be re-examined in order to select the 8 most suitable candidates. Only the following factors will be considered in this re-examination:
1. highest number of projects under criterion 3(a).
If more than 8 candidates still remain after applying factor 1 'Highest number of projects under criterion 3(a)', factor 2 will be applied in order to reduce the list to a maximum of 8:
2. highest number of projects under criterion 3(b).

In this case, the acknowledgement of receipt will attest to compliance with the deadline for receipt.
The envelope containing the application must be clearly marked with the contract title and the publication reference (see point 1 above). These must also be quoted in all subsequent correspondence with the contracting authority.
Applications sent in any way other than this will not be considered.
When submitting their proposals, candidates agree to receive notification of the result of the procedure by electronic means. The notification shall be deemed to have been received on the day the contracting authority sends it to the e-mail address stated in the application.
26.Amendments to, or withdrawal of, applications:
Candidates may give notice in writing before the deadline for submission of applications that they intend amending or withdrawing their application. Applications may not be amended after this deadline.
Any notification of amendment or withdrawal must be submitted in accordance with point 25. The word 'Modificación' (amendment) or 'Retirada' (withdrawal), as applicable, must be written clearly on the outside envelope (and on the corresponding inside envelope).
27.Operational language:
All correspondence concerning this invitation to tender procedure and contract must be in Spanish.
