VII.1.4)Description of the procurement:

Ajánlatkérő számára a lakásbiztosítások nyilvántartásának és ezek hitelbiztosítékként történő nyújtása üzleti folyamata támogatásának megvalósítása osztott főkönyv technológiájú informatikai megoldással (DLT= Distributed Ledger Technology, a továbbiakban: Rendszer),valamint a megvalósított rendszer üzemeltetés támogatása. A Rendszert 14 db csomóponttal kell kialakítani, amelyekből az egyik csomópont az AK-nél, a többi csomópont a projektben résztvevő biztosítóknál kerül üzembe helyezésre, ugyanakkor biztosítani kell további csomópontok kialakításának és csatlakozásának a lehetőségét. Az MNB csomópontjával és a résztvevő biztosítók infrastruktúráján üzemeltetendő 13 csomóponttal működő megoldás a technológia hosszú távú alkalmazhatóságának bizonyításán túl konkrét üzleti folyamatok kezelésére szolgál.

Megvalósítási szakasz-mérföldkövek:1. Előkészítés, rendszertervezés; 2.Fejlesztés, tesztelésre átadás 3.Tesztelés, hibajavítás 4.Éles üzembe helyezés 5.Használatbavétel, projektzárás

Üzemeltetés támogatás: Bejelentések kezelése, Helpdesk és helyszíni támogatás, Követés, Hiba megelőzés, Incidenskezelés (ezen belül: hibajavítás, napi üzemeltetési feladatok során keletkező incidensek elhárítása, hibajavítások átadása), Rendelkezésre állás, Rendszer karbantartás (ezen belül: Log-elemzés teljesítménymérés és teljesítmény optimalizálás, mentésekben, archiválásokban és visszatöltésekben való közreműködés, telepítési támogatás), Egyéb támogatási feladatok (ezen belül: forráskódváltozással nem járó feladatok, felhasználói megkeresésekre történő konzultáció).

VII.2.2)Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

A Szerződés elválaszthatatlan részét képező Műszaki leírás nem határozza meg az alkalmazandó konténerizációs platform típusát és arra, hogy a Vállalkozó a Megrendelővel egyetértésben az Ml Mérföldkő Rendszertervezési fázisban a VMware Tanzu és Vanilla Kubernetes konténerizációs környezetet határozta meg, így a rendszerfejlesztés jelen fázisában (M2 Mérföldkő) a Rendszer új platformon való megvalósítási igénye a Felek álláspontja szerint a Vállalkozó által előre nem látható pótmunkára vonatkozó igénynek, úgyis mint Change Request-nek (,,CR"-nek), azaz változáskezelésnek minősül. Erre tekintettel Felek az M2 Mérföldkő teljesítési határidejét 43 munkanappal meghosszabbították, ekként az M2 Mérföldkő határideje 2021. október 29-ére változott.

A szerződésmódosítás jogalapja az értéknövekedést illetően a 141. § (2) bekezdése és ezzel összefüggésben a határidő módosítás tekintetében ugyanezen jogszabályhely (3) bekezdése, mivel a határidő módosítás a 10% -ot el nem érő értéknövekedést megalapozó, a technológiára vonatkozó megrendelői változtatási igénnyel áll összefüggésben. Az. ún „de minimis” módosításra a 141 § (4) bekezdésében foglalt jogalapok vizsgálata nélkül van jogi lehetősége ajánlatkérőnek. Ajánlatkérő a Kbt.141.§ (4) bekezdés c) pontjára nem hivatkozik, ezért a módosítás szükségességét indokoló körülmények előre nem láható jellegének magyarázata nem releváns.
