This Invitation for Tenders follows the General Procurement Notice for this project which was published on the EBRD website, Procurement Notices (www.ebrd.com) on 15 May 2015 and recently updated on 23 June 2016.

Astana LRT LLP, a public transport company of the City of Astana hereinafter referred to as “the Purchaser”, intends to use part of the proceeds of a loan from the European Bank for Reconstruction and Development (the Bank) towards the cost of Astana Bus Project.

The Purchaser now invites sealed tenders from Suppliers for the following contract to be funded from part of the proceeds of the loan:

Package ABP01 – Supply of new low floor diesel buses (165 rigid, 15 articulated and 20 diesel-electric hybrid buses) and related services.

Tendering for contracts that are to be financed with the proceeds of a loan from the Bank is open to firms from any country.

To be qualified for the award of a contract, tenderers must satisfy the following minimum criteria:

a) Tenderers shall meet the eligibility requirements: no conflicts of interest, not having been declared ineligible by the Bank, compliance with requirements of tender documents for government owned entity if a tenderer is owned by the government, not having been excluded as a result of the Borrower’s country laws or by an act of compliance with UN Security Council resolution.

b) In the case of a tenderer offering to supply goods under the Contract which the tenderer does not manufacture, the tenderer has been duly authorised by the goods’ manufacturer to supply the goods in the Purchaser’s country in accordance with the requirements of the Tender documents.

c) Non-performance of a contract did not occur within the last 3 (three) years, based on all information on fully settled disputes or litigation. All pending litigation shall in total not represent more than 20% (twenty percent) of the Tenderer’s net worth.

d) The audited balance sheets for the last 3 (three) years must demonstrate the soundness of the Tenderer’s financial position.

e) Minimum average annual turnover of at least EUR 170 million or equivalent, calculated as total certified payments received for contracts in progress or completed, within the last 3 (three) years.

f) The Tenderer shall demonstrate that it has access to, or has available, liquid assets sufficient to meet the production cash flow for the contract estimated as not less than EUR 50 million or equivalent, taking into account the Tenderer's commitments for other contracts.

g) A Tenderer conducted a successful delivery outside of manufacturing country of at least 500 new public transport buses any model over 16 T. GVW certified in accordance with the EU Whole Vehicle Type Approval over the past three years.

h) The Tenderer or its agent will be able to carry out the supplier’s maintenance, repair and spare parts stocking obligations in the Purchaser's country.

i) Capabilities and experience of manufacturers: produced and delivered outside the country of manufacturing in total at least 300 rigid and 50 articulated diesel buses of the same bus model as defined in the Tender certified in accordance with the EU Whole Vehicle Type Approval to at least 3 different bus operators during last 3 years; produced and delivered outside the country of manufacturing in total at least 50 hybrid buses of the same bus model as defined in the Tender certified in accordance with the EU Whole Vehicle Type Approval to at least 2 different bus operators during last 4 years; the manufacturer must have a certificate of quality management system (ISO 9000, or its equivalent).

Tender documents may be obtained from the office at the address below upon payment of the non-refundable fee of 100,000 (one hundred thousand) Kazakhstan tenge, including VAT, or equivalent in a convertible currency by exchange rate of National Bank of Kazakhstan on the date of payment.

Upon receiving appropriate evidence of payment of the non-refundable fee, the documents will be promptly dispatched by courier, however, no liability can be accepted for loss or late delivery. If requested the documents can also be dispatched electronically after the presentation by the prospective tenderer of appropriate evidence of payment of the non-refundable fee. In the event of discrepancy between electronic and hard copies of the documents, the hard copy shall prevail.

All tenders must be accompanied by a tender security of 1,300,000 EUR (one million three hundred thousand) or its equivalent in a convertible currency.

Tenders must be delivered to the office at the address below on or before 15:00 (local time) 29 August 2016 at which time they will be opened in the presence of those tenderers’ representatives who choose to attend.
