The Norwegian Defence Logistics Organisation hereby terminates this tender process for a framework agreement for the delivery of exercise batteries for torpedoes, in accordance with FOSA § 13-1 (1).

The evaluation of the requests for participation concluded that only one contractor could show good experience with similar deliveries in regards to the Li-ion battery included in the competition as an option.

The European Court of Justice has confirmed that where only one contractor is qualified this is grounds for termination of a procurement process (see C-23/98).

Furthermore the circumstances has changed and it has been concluded that there is no longer a need for a Li-ion battery within the time frame of the framework agreement.

Therefore NDLO hereby terminates this procurement process. NDLO will make the necessary changes to the documents and start a new procurement process for this framework agreement.
