Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Dodatok č. 1: predĺženie trvania zmluvy je preklenutím obdobia do obstarania novej zmluvy o poskytovaní a prevádzkovaní služieb siete LAN/WAN. Dodatkom sa nemenil charakter zmluvy, pretože sa nemení obsah práv a povinností zmluvných strán a ani samotný charakter požadovaných a zazmluvnených služieb.

Dodatok č. 2: predseda ŠÚ SR rozhodol o presťahovaní ústredia ŠÚ SR do nových priestorov z dôvodu havarijného stavu súčasnej budovy ústredia. So sťahovaním do nových priestorov je nevyhnutne spojený aj presun infraštruktúry, vrátane zmeny miesta plnenia služieb, ktoré ŠÚ SR poskytuje dodávateľ. Aby dodávateľ mohol riadne poskytovať svoje služby zo zmluvy, je nevyhnutne potrebné vykonať prekládku telekomunikačných služieb. Táto prekládka si však vyžaduje zvýšené náklady, ktoré nemožno financovať z ceny za doposiaľ zazmluvnené služby. Verejný obstarávateľ nemohol v čase uzavretia zmluvy v roku 2016 predvídať, že počas trvania zmluvy dôjde k zmene miesta plnenia zmluvy a služby prekládky.
