BACKGROUND

The UNDP Decentralisation and Local Development Support Programme (DLDSP) provides support to the Government of Jordan to effectively manage and guide the implementation of decentralisation reform through the application of the Decentralisation and Municipalities laws of 2015. The DLDSP operates through the Local Development Directorate (LDD) at the Ministry of Interior (MOI) and through its corresponding LDD at the Ministry of Municipal Affairs (MOMA). It functions under the guidance of the Inter-Ministerial Committee (IMC) for Decentralisation and its Executive Committee and its sub-committees. The DLDSP is funded by the European Union.

The DLDSP seeks to achieve three results:

1-                The policy/ regulatory framework pertaining to Decentralisation has been adopted;

2-                Capacities of the Governorate-based structures in strategic planning, budget analysis and monitoring are strengthened;

3-                Participatory development plans have been properly elaborated in Governorates through strengthened dialogue with Non-State Actors and increased citizen’s participation (including identification of local productive projects to be established).

The Decentralisation process in Jordan is implemented in line with Law 49/2015 on Decentralisation and Law 41/2015 on Municipalities.

The DLDSP is mandated to provide a support to amend and regulate the Law 49/2015 and Law 41/2015 by providing a technical assistance to the Legislations Committee under the supervision of the Executive Committee. In addition to a survey and collection of relevant legislations was carried out:

Tier 1: Legislation directly covering work of governorate councils and municipal councils.

Tier 2: Legislations indirectly relevant to work of governorate councils and municipal councils.

Tier 3: Legislations on central sectors with field services. This phase includes a comprehensive survey of the relevant legislation; i.e. laws, bylaws or instructions.

Objective

The objective of this assignment is to support the development of a comprehensive legislative and regulatory framework for Decentralisation that clearly defines and establishes the role, powers and duties of governorate councils, municipal mayors, municipal councils and local councils to achieve participatory local governance and local development, integrated development planning and effective services delivered by governorate and/or municipalbodies.      

Scope of Work

The expert will work under the supervision of the DLDSP Programme Manager and in close collaboration with DLDSP staff members and related UNDP programme advisors and managers. The expert will engage closely with the members of the Legislation Sub-Committee of the Inter-Ministerial Committee, which is headed by the Director of Legal Affairs Directorate at MOI and which includes representatives of the Legal Affairs Department at MOMA. The expert will also engage with other relevant government officials and actors engaged in the Decentralisation process.

In particular, the expert will support the missions of the policy and technical advisory services in support of Decentralisation reforms in:

1. Assist in amending and regulating the Law 49/2015 and Law 41/2015, to ensure that their implementation remains consistent with the medium-term goal of establishing ‘developmental’ sub-national authorities, that operate with meaningful autonomy and appropriate accountability.

2. Assist in carrying out the national dialogue;

3. Support to the formulation of a Decentralisation Implementation Programme (DIP): based on the scoping mission, national dialogue and roundtable discussion’s main findings and recommendations, the consultancy will provide support technical support to creation of the Council or Unit of the State administration, to manage the DIP under the designated office (i.e. the Prime Minister’s office).

4. Draft text of and/or amendments to legislation, regulations and policies that are necessary to strengthen the decentralisation process including improvements to economic development interventions at local level;

5. Engage with key stakeholders on the decentralisation process and in discussions on reform, such as the Legislative Interpretation Bureau, Members of Parliament, legal representatives, related civil society organizations, etc..
