IV.1) Description
IV.1.1) Type of procedure
Negotiated procedure without prior publication
Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation:
A Prior Information Notice (PIN) was published via Public Contracts Scotland (PCS) on 18 August 2021, with a request for interested parties to register their interest no later than 12 noon on 03 September 2021. 11 companies noted an interest by this specified closing date, and as part of market engagement for this opportunity, a questionnaire was issued to those same suppliers. The University has found that based on all questionnaire responses received, only 1 company (Toshiba Carrier UK Ltd (03723803)) can fulfill the requirements set out under the Prior Information Notice (PIN).
As such, the University's requirement falls under the circumstances set out under The Public Contracts (Scotland) Regulations (2016), Regulation 6 - Circumstances in which a contract can be awarded without competition; - (1) A contracting authority may award a public contract without seeking offers in relation to the proposed contract - (b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons - (ii) competition is absent for technical reasons.
Therefore it has been determined that the appropriate route to market for this requirement is the use of the negotiated procedure without prior publication in accordance with The Public Contracts (Scotland) Regulations 2015, Regulation 33 – Use of the Negotiated Procedure without Prior Publication; - (1) A contracting authority may award a public contract following negotiated procedure without prior publication of a contract notice or prior information notice in any of the following cases - b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons - (ii) competition is absent for technical reasons.
